Kazakhstan strengthens copyright penalties and launches a digital works registry platform

A newly adopted law on intellectual property both increases liability for copyright infringement and introduces digitalization in this field. According to Deputy Minister of Justice Botagoz Zhakselekova, illegal commercial use of works now entails fines from 80 to 160 MCI, up to 160 hours of community service, or restriction of freedom for three to six years.

The law enhances oversight of collective rights management organizations (CMOs). The authorized body may suspend accreditation in case of violations, while unscheduled inspections will be conducted only upon requests from authors and rights holders.

A key innovation is the Unified Digital Platform, which will record the use of works and automatically distribute royalties. Authors will be able to track where and how their content is used, while users can confirm the accuracy of accounting.

Implementation will be phased: from the law’s entry into force for TV and radio, from July 2026 for theaters, cinemas, and philharmonics, and from January 2027 for all other users.

The platform provides automatic accounting: for example, if music is broadcast, the system will record it and allocate royalties to the author. Work is underway to connect TV and radio to the system.

The law “On Amendments and Additions to Certain Legislative Acts of the Republic of Kazakhstan on Intellectual Property” was signed by the President in late November this year.

The new norms combine stricter sanctions against violators with digital tools for accounting, which authorities believe will make royalty distribution more accurate and transparent.
