The Constitutional Court of the Republic of Kazakhstan has considered a citizen's appeal regarding the ban on video cameras in personal hygiene rooms, treatment rooms and operating rooms.

According to the applicant, as a result of his stay in the intensive care unit of a certain medical institution after the operation he had undergone, "medical personnel took action with the aim of taking his life and illegally removing organs for transplantation."

The man asked to check paragraph 12 of the Rules for the use of technical control means, surveillance and recording devices, photo and video equipment used in medical organizations in order to ensure the protection of the rights of patients and medical workers (Order of the Ministry of Health dated 30.12.2020 No. ҚР ДСМ-335/2020) for compliance with the Constitution.

The said case was the subject of consideration by the prosecutor's office and the court, which did not reveal any violations and refused to install video cameras in the intensive care unit with reference to the said norm.

The Constitutional Court, after examining the case, noted that there are already sufficient legal instruments for judicial protection in such cases and came to the conclusion that there are no acceptable conditions for checking the said norm for compliance with the Constitution.
