New rules for restricting access to Internet resources in Kazakhstan

The Ministry of Culture of Kazakhstan has approved new rules regarding restricting access to Internet resources, foreign online platforms and instant messaging services.

According to the new rules, monitoring of materials with violations of the law posted by users of instant messaging services is carried out on the basis of user requests.

In this case, the violation must be repeated.

If the authorized body (AU) identifies such violations, it sends a notification letter to the administration of the foreign online platform within three working days to remove the prohibited information.

If the activities of a foreign online platform are identified as violating the law, the MA sends its owners a notice of the need to comply with the requirements of the law “On Online Platforms and Online Advertising.”

If the platform does not comply with the requirements within eight months, the MA requests statistical data on the platform’s traffic capacity from the State Technical Service (STS). The GTS collects this data and transmits the results to the MA.

If the foreign platform continues to violate the requirements, the MA issues an order to take measures to restrict access to the platform. Measures include access restrictions of 10%, 50% and 90% of the maximum statistical data (user traffic) depending on the period of non-compliance with the requirements.

To put it simply, first a certain platform will be blocked for 10% of users from Kazakhstan, then for 50%, etc.

The new rules will come into force on July 8, 2024. They are designed to strengthen control over the Internet space of Kazakhstan and ensure compliance with the law.

Thus, the authorized body carries out very comprehensive monitoring of foreign online platforms, including based on requests from the users themselves.
