Towers without consent: Kazakhstan proposes to simplify the installation of telecom equipment on buildings

Kazakhstan plans to simplify the installation of mobile base stations on the roofs of apartment buildings. The corresponding draft law was published by the Ministry of Digital Development on the Open NPA portal and is under public discussion until June 4, 2025.

According to the document, telecom operators will be able to install equipment without obtaining the consent of all residents.

The proposed amendments concern the Law "On Housing Relations" and introduce a new article 38-1, detailing the conditions for the placement of telecommunications equipment in condominium facilities.

Currently, the consent of all apartment owners is required to place equipment in residential buildings. New amendments to Article 42-5 of the Law "On Housing Relations" propose to cancel this requirement, subject to the availability of a sanitary and epidemiological conclusion.

In addition, property owners are required to provide space for the placement of equipment on equal terms.

The amendments stipulate that telecom operators must receive a response to their request from residents' representatives within 15 working days. The lease agreement for the premises must be concluded free of charge.

Additionally, it is proposed to recognize antenna mast structures up to 30 meters high as temporary objects. This will free operators from the need to obtain construction permits and register such towers as real estate.

Changes are also being made to the Land and Urban Development Codes. The right of ownership of the towers remains with the operator, and the right of ownership of the land with its owner. This simplifies legal procedures, especially when renting land from private individuals.

The draft stipulates that towers can also be placed along highways. This will improve coverage in remote areas and reduce infrastructure costs for telecom operators.

The developers believe that the innovations will provide access to more stable communications, including for emergency services and online services.

After the discussion is completed, the draft law will be sent to the Majilis.

It is also worth mentioning why some residents may be against the installation of telecom equipment. The fact is that some people may associate electromagnetic radiation from cell towers with a negative impact on their health, such as headaches and ailments.

However, there is no reliable scientific evidence of the harm of base stations. Also, some people may be against towers for aesthetic reasons, that they will spoil the appearance of the house.
