Two laws have come into force in the European Union aimed at regulating the activities of large online platforms:
-
Digital Services Act (DSA)
-
Digital Markets Act (DMA).
They set the rules for companies that have a significant impact on the digital economy and millions of users around the world.
The influence of these two legal acts is very wide, and it mainly concerns such large companies as Apple, Meta, Amazon, Google, etc.
If a company has an audience of over 45 million users in the EU, and an annual turnover of 7.5 billion euros in the last three years, it is subject to regulation.
Under the new rules, companies will have to allow users to install applications from third-party sources and remove pre-installed programs upon request.
Developers will also be able to use their own payment systems, which directly corresponds to the interests of companies such as Epic Games, which have already fought for these rights.
In addition, IT giants will be required to share data with representatives of other industries and refrain from promoting their own interests to the detriment of competition.
This includes the ability to use various payment systems and avoid the practice of monopolization through proprietary platforms.
These measures are aimed at creating fairer market conditions and ensuring user access to a variety of applications and services.
The legislation also introduced the concept of an “intermediary” (or “gatekeeper”), which can be companies with a “strong economic position” and significant influence on the EU market.
In the long term, this should promote competition and improve the quality of digital services.
The new laws also aim to protect user rights. For example, ads cannot be targeted at children, and ad settings cannot take into account users' nationality, sexual orientation, or political views.
The legislation also obliges social networks to take measures to protect users from illegal content. Posts that spread hate or misinformation are subject to prompt removal.
Violation of all the above rules will be severely punished with large fines.
